PreviewFirst Terms and Conditions

Our foremost objective is to provide you with excellent service. These terms and conditions are in effect to further clarify our responsibility to each other and to make sure we all have the same expectations before agreeing to do business together.

When ordering products and services from PreviewFirst.com, you acknowledge that you have agreed to become a party to and legally bound by these terms and conditions. If you do not wish to be bound by these terms and conditions, you may not access or otherwise use the services of PreviewFirst.com.

PreviewFirst.com (otherwise known as Company) virtual tours are displayed using a file format requiring Windows Media Player 9+ by Microsoft Corporation, and a compatible web browser is necessary. PreviewFirst.com tours are best viewed at 1024 x 768 screen resolution and require a broadband connection.

Virtual tours remain hosted for a period of one (1) year, at which time Client will be given the opportunity to keep it available for $10/yr.

There are no refunds; however Company may in its discretion provide virtual tour credit.

Once photos are uploaded by Client, and the virtual tour order is finalized, it can not be modified without incurring an additional expense.

There is a charge of $39 to modify a Virtual Tour in any form.

Virtual Tour Services:

1. Copyright Materials: PreviewFirst.com cannot accept or add any copyrighted photos to the virtual tour. Client expressly states that Client has permission to use or owns the copyrights on all images provided to PreviewFirst.com.
2. Photography Credits: PreviewFirst.com does not publish the name of the photographer. When the photography is Provided by PreviewFirst.com, the virtual tour will say "Professional photography services provided by PreviewFirst.com.
3. Uploading Photos: Client agrees to closely follow the instruction on our website for taking and uploading photos. Company will develop the virtual tour using the photos as they are and in the order they are provided by the Client.
4. Turn Around Time: PreviewFirst.com guarantees 24 hour turn around time or you will get your next virtual tour for free. If photos are provided on a Friday, the Virtual Tour will be ready by the same time on the following Monday. An order qualifies as "In Progress" upon finalization of the order.

Photography Services:

1. Client understands that there are two types of photography offered by PreviewFirst.com; Virtual Tour Photography and Twilight Photography. Virtual Tour photography is conducted during the daytime hours or 9:00am to 4:00pm, Monday through Friday. Client understands that it can be very difficult to balance the strong daylight outside with the interior lighting of a home, which may result in bright windows. Our photographers do their best to avoid overexposing the windows; however, it is sometimes necessary in order to expose the interior of a property properly. Twilight photography is offered for properties where views and exterior lighting are important. These photographs are taken during the last 90 minutes of sunlight, which provides the optimum lighting conditions to balance the interior lighting with the exterior.
2. It is understood that any and all originals, proofs, sample prints, and digital representations remain the property of PreviewFirst, and they may be used for advertising, display or any purpose thought proper by PreviewFirst.
3. Client agrees that the property will be ready for photography to commence when photographer arrives for the scheduled appointment.
   • All lights should be turned on, including any table lamps, closets, bathrooms, etc.
   • Hot Tubs and waterfalls should be turned on.
   • Pool equipment and clean sweepers should be out of site.
   • Items not intended to be in the photographs, such as toys, laundry, cleaning supplies, newspapers, jewelry, pool cleaning equipment, tools, etc, will need to be stored out of site before the photographer arrives.
   • All vehicles should be removed from the driveway and garage doors closed.
   • Client should open all window coverings.
4. Photo sessions must be scheduled with company personnel via phone or via the PreviewFirst.com website Virtual Tour ordering process.
5. When ordering photography service for multiple properties, each residential address (whether a duplex or neighboring home) is considered a separate location and requires a separate order. This policy applies regardless of the square footage or number of photos requested.
6. Client understands that our photographers are contract photographers and that photographers are not equipped to provide PreviewFirst.com service and support. All questions pertaining to a virtual tour order, server or support must be conducted via phone or email with qualified Company personnel.
7. Client agrees to defend and hold Company and photographer harmless regarding any damage to property or furniture, including accusations of theft. In the event that photographer accidentally breaks or otherwise damages personal property while in the course of photographing the property, client agrees to reimburse seller for any and all expenses involved and will not demand reimbursement from Company or photographer.
8. Client agrees to include the following copy along side, on top, or underneath any photo provided by PreviewFirst.com in clients advertising: Photography by PreviewFirst.com
9. Client agrees to pay an automatic rescheduling fee for any orders rescheduled less than 24 hours in advance, as follows: STANDARD PHOTOGRAPHY $25 - TWILIGHT PHOTOGRAPHY $175.
10. Client agrees to pay an automatic cancellation fee for any cancellations not made at least 24 hours prior to the scheduled photoshoot, as follows: STANDARD PHOTOGRAPHY $50 - TWILIGHT PHOTOGRAPHY $175.
11. In the event that nobody shows up at the property to assist the photographer with access, photographer will wait 15 minutes, before leaving. Client agrees to pay an automatic cancellation fee for any missed appointments.
12. Client agrees to notify Company if Client is running late. Whenever possible, photographer will wait at the property until Client arrives. Client understands that photographer may have another appointment immediately following and may not be able to wait or complete the photoshoot. If Client chooses to reschedule photoshoot, the reschedule fees are areas follows: STANDARD PHOTOGRAPHY $25 - TWILIGHT PHOTOGRAPHY $150.
13. Client agrees to provide Company with all necessary contact information, so that in the event the photographer is lost or otherwise late, Company or Photographer can contact client.
14. Virtual tour turn around time is 24 hours, beginning at 8:00pm the day of the scheduled photoshoot. When photographs are taken on Friday's the virtual tour will be ready by 5:00 pm the following Monday.
15. High resolution image files will be removed from the web server within 60 days. Original photographs are deleted and no longer available after sixty (60) days.
16. When specifically requested to do so by the client, and to the best of its ability, PreviewFirst will digitally remove certain objects (whether permanent or temporary) from a photograph. However, PreviewFirst strongly advises against the use of such photos for advertising purposes if what is being advertised is false or misleading in any way, and PreviewFirst is not responsible or liable for the way in which a photo may be used by the client.

Customers may use their own photos to create a virtual tour. Client expressly states that client has been given the authority and express permission by property owner to post photographs of property on the internet for advertisement purposes. PreviewFirst.com is not responsible for any cause or claim against client arising out of this agreement. Client agrees to defend Company and hold company harmless from any accusations of theft or property damage.

When Photography Services are ordered, Company strongly recommends that the home owner or the Client accompany the photographer while photographing the property. If neither Client nor homeowner is present at the time the tour is photographed, and the Client has made no prior requests regarding shot selection, the shots taken will be at the discretion of the photographer. PreviewFirst.com claims no responsibility for the photographer's selection of shots except in cases of extreme negligence.
